The Current Status and Prospects of Medical Record & Privacy Protection Policy

Abstract

|
The medical record means the information which is produced in relation to the medical treatments of medical practitioners for curing their patients, including all sorts of documented records and all the features of patients’ bodies or diseases. Such medical record is the privacy which belongs to the typical secret domain of personal private life, and at the same time it is the personal information which should be protected constitutionally. However, although recently the infringement cases of personal medical record have occurred and so the problems about it have been pointed out, it has not yet been referred to public opinion.So, the purpose of this study was to classify the current protection policies of personal medical record into the three elements including security, privacy, and confidentiality, and then present the desirable policy orientations toward the protection of medical record as the principal social problem.As the concrete policy orientations toward the protection of medical record, the countermeasures for the protection of patients’ medical record should be strengthened within medical institutions, and the provision of medical record to the third party should be prohibited strictly, and the protection of patients’ medical record related to the payment of medical treatment fee should be strengthened. Also, the protection committee of medical record should be organized to deliberate and examine essential matters within each institution. Because the protection of medical record is the principal responsibility of medical practitioners, the medical practitioners should make their leading efforts to protect the medical record and should prepare the concrete and substantial measures through referring socially to public opinion.
